County and every single municipality not just in Arizona and around the country and I'll be repeating those again before public comment uh thank you very much for coming Madam clerk please call the Ro good morning thank you supervisor Stewart here supervisor broy McGee here supervisor leco here supervisor Gallardo who's joining us remotely here thank you chairman Galvin here thank you uh we have folks here for the prayer and the pledge and uh supervisor letco please uh introduce Our Guest today thank you Mr chair today I am honored to have a very special guest with us uh Dr Anthony Allen Dr Allen is the vice president of advancement at the Arizona Christian University which is in my district right up the street from where I live chairman I would like to say a few words after Dr Allen gives us the prayer and pledge wonderful Dr Allan thank you for coming this morning and I ask everyone to please rise let's pray together father maker of the heavens and the Earth creator of all things we bow before you today and give you thanks we thank you Father that not only are you the creator of all things but you're creators of All Peoples so Lord we come today and recognize that you have ordained government to serve and to lead those that are in our County and today we just pause to give thanks for them we pray your blessings upon them as they serve this County and the people of this County we pray that you would bless them and give them wisdom uh to serve and to lead in ways that would honor you and would benefit your people so father we just ask you to bless our time together today in Christ's name amen amen would you repeat the pledge with me today I pledge allegiance to the flag of the United States of America and to the Republic for which it stands one nation under God indivisible with liberty and justice for all Dr Allan thank you so much for that wonderful invitation supervisor letco yes thank you Mr chairman thank you Dr Allen and I have to say I'm excited that you're here um as most of you know Len msel is the president of Arizona Christian University and they used to be in the East Valley probably your district and uh now a few years ago they moved um up to um is it 59th Avenue in Greenway uh which is right in my supervisor District so uh Dr Anthony Allen is the vice president of advancement at the Arizona Christian University uh he is a native of North Carolina and received his undergraduate education from Duke University where he graduated in 1990 with majors in history and religion Dr Allen was also a gritan standout for Duke and a member of the 1989 Atlantic Coast Conference football co- Champion team yay um Dr Allen continued his education at Southeastern Baptist Theological Seminary located in Wake Forest North Carolina where he completed two degrees a master of divinity with Biblical languages and a master of theology in Christian ethics Dr Allen is the author of two books Christian higher education why it matters and seven affirmations for Christian higher education a collection of writings in addition to these experiences he has also served as pastor and has spoken widely both nationally and internationally Dr Allen is married to Stacy Coy Allen and they have five children Bethany E E Evan Evan uh Leighton Analise and Brin Brinley hobbies include hiking fishing hunting and all things outdoors it is with great admiration that I acknowledge the accomplishments of Dr Allen both in education and is in in his professional work his un unwavering faith in God and dedication to his community serve as a true inspiration to us all it is an honor to have you lead us in the prayer and pledge today and I understand you could have also sang the national anthem for us so maybe next time you're here we'll have you do that as well and uh thank you again for being here it's an honor to have you and with that I yield back thank you supervisor that was wonderful okay moving on to item number four pet showcase by Maricopa County Animal Care and Control and from what I can tell that is a very colorful dog it is oh this is not her natural hair color but thank you for asking uh in case you guys didn't know on Wednesdays we wear pink that's a Mean Girls reference if no one knew um I got plenty of them for you today this is Luna uh Luna is about 10 years old uh she came into the shelter as a stray from wadell uh she is microchipped and clearly recently groomed uh her groomer actually reached out to us when they saw her photo going around on social media and said I remember this dog here's the owner's contact information unfortunately we were not able to get a hold of them over the last 5 days so she is now available for adoption um and again she's very well- groomed very well trained uh if you can sit to have your hair dyed pink I'd say say you're pretty well trained uh if pink is not your color that's okay because much like my $200 highlights they will fade away and not to mention she's a husky so it will also shed so I don't shed like a husky at least uh she knows sit down Shake uh I we're kind of learning more tricks she's extremely treat motivated uh I've noticed that if you're walking through a door she will sit and wait for your permission so she she is a very well-trained dog and very polite and uh just overall really loving and friendly and would probably love a a great home to spend her senior years she she wants may back um she is already spaced so that means she can go home today and until then she will be dancing at the pink puppy Club okay you guys got that one aka the West shelter Kim thank you and Kim I want to I want to take a moment right now to thank you and your team on Saturday we had an event uh at PetSmart in Scottsdale here in District 2 in my district and what you are doing with PetSmart Charities is just unbelievable and amazing and our director Debbie mcnight we now have 46 kennels County kennels at PetSmart in Oldtown Scottsdale at what it's now called the everyday adoption center and I was there on Saturday County Manager Jen pakori was there a lot of staff was there Michelle from my office was there and it was just a wonderful event and it just shows that the cooperation the collaboration between public public and private Partnerships can do a lot not just for people but for our four-legged friends so Kim please thank our team your team on our behalf for the great work that you guys are doing and I know Luna wants to leave because who wants to hear politicians talk but thank you so much oh thank you guys for your support too and and again Pet Smart Charities is amazing so we're excited to have our new everyday adoption center congratulations thank you thank you okay I'm going to ask that we move uh two items from our regular agenda up now to be heard one is going to be require unanimous consent of the board and supervisor gardo has a hard stop in a little bit and then we have an important vacancy appointment to make right afterwards so I'm going to pull up Board of Supervisors regular agenda real estate 60 Resolution authorizing board chairman to execute certain utility easements this requires the unanimous consent of the board Madam clerk do we have any speakers for item number 60 chairman supervisors I did receive um eight speaker forms okay you would like me to call on the first person well I'm going to ask uh do we have anyone from staff who can speak to this item right now Alex please come forward um I would love a presentation and if you can identify yourself for the board and for the people watching thank you Mr chairman Alex Smith real estate director for Maricopa County this item is to allow the chairman to execute utility easements without further board action once we have unanimous consent of the board the easements are for utility purposes only and they are required to be for um utility easements that are related to plans previously approved by the board for the construction of the downtown elections facility great so when you say this provides the chairman The Authority this is just for for the ease of not having to have the whole board being consulted Mr lydy I see you're nodding your head if you want to come forward and talk about the legal reasons for this item and Alex you going to say something please go ahead yeah and I might note Mr chairman that we've done this twice in the past once for the Maricopa County Sheriff's warehouse at the Durango campus and also the uh soon to be constructed uh Library District sorting facility also at the Durango campus okay thank you Mr lyy yes uh Mr chairman so the board has already acted on and using its discretion and for its ability to deliberate so the what the acts that are covered under this are purely ministerial to allow the um utility easements to be in place while the construction is going on so everything that this is authorizing you to do alone is ministerial and um so if now is the time for the board to deliberate and either authorize you to do those ministerial Acts or not right and this is a power granted to any chairman who happens to be chairman for that calendar year or for that duration just to act on behalf of the wishes of the board correct it's it's a normal way of doing business all throughout the country okay thank you supervisor letco yes thank you Mr chair and uh Alex is this um just related to the new building the new election building that is being constructed nothing else chairman member leco yes that is correct it is exclusively for the new the new elections building and um Mr chairman and uh Alex if we did not give authorization to the chairman what would happen every time the utility company needs an easement on this property they would have to wait till the next board meeting and get our approval is that what would happen risor Galvin um member leco yes that is correct thank you Mr chairman okay and Mr ly I'm sorry I'm going to ask you to stay for the duration Mr Smith as well just in case anything comes up uh there are eight people signed in to speak in this item hopefully that already answered your questions but if you still want to speak please come ahead so uh Madam clerk I'm going to ask you to call the three names so these people know who's coming up who's on deck and who's in the hole so please call out three names thank you chairman first up Don Adams followed by Marissa Hamilton then Tom Arnold this what's this for Mr Adams this is for item number 60 please come forward good morning U vard chairman agenda item 60 I raise here today not only to speak against agenda item 60 but to address the broader issue of leadership and accountability chairman Galvin being the topic of this agenda item then must be addressed board chairman Galvin has recently been publicly rebuked by his own political party with a resolution labeling his behavior as Reckless and unprofessional and yet the rest of the board most of whom share political Madam Vice chair I would like to be respectful to the speaker but I ask Mr chairman that the comments pertain to the specific item the resolution Mr ly Mr chairman Mr chairman um item number 60 uh it is is an item in which the all the members of the board are considering whether to give you this specific power over this ministerial stuff so I would think it would be Germain for a member of the public to speak about you about whether or not you should be the one to get the power so I think it would probably be appropriate uh during the two-minute presentation given what I've heard from the okay from the speaker thank you madam Vice chair go ahead sir instead of stepping up and choosing a new chair you've choosen silence let it be clear silence is complicity the the public sees this sadly we see a board more interested in preserving the status quo rather than in restoring public trust we see you justifying the unjustifiable true leadership requires courage not comfort and right now this board is failing that test thank you thank you Mr Adams supervisor letco Mr chair I just have a point of order I'd asked a couple times now today I've heard people from the audience just yelling out not so or whatever I would I'm not used to this cuz in the state legislature in Congress you just don't have people screaming out stuff and so I would ask everybody you know just to take a turn do the two minutes but not um you know just yell out stuff from the audience and with that I yell back thank you supervisor let's go Madame Vice chair Mr lydy you lost us perhaps in your legal e about ministerial that means somebody on behalf of the board has got to it's more efficient to have someone signed in with this direct unanimous consent authorization that means everybody votes to do that authorizes one person to sign in this case the chairman correct that's correct but not for everything only for ministerial acts and those are acts that don't require the discretion of elected um Personnel in in this instance what that literally means is when a utility company is coming in saying we're going to dig a trench in order to put a power line in can we do that well to authorize that is ministerial yeah and also Mr chair I'm sorry Mr lyy I don't think this is about me per se but about the Chairman's office so for whatever reason let's say I got hit by a bus tomorrow I sure hope not uh whoever would be chairman going forward would have to help execute all of these items that Mr Smith brought forward this year that's correct Mr chairman that would most likely be the vice chair so I think this goes to generally the chairman not the specific person 100% correct okay thank you next speaker please next item number 60 Marissa Hamilton followed by Tom Arnold and then Lisa ESET thank you m clerk uh chairman supervisors um I'm opposed to this item number not just because uh I don't think chairman Galvin is fit to be in that position uh but also because of the fact that the recorder's office is not on record according to the agenda as to having approved this or waited on it or or heard anything on it and I understand that this is a ministerial item but there are other some there are other things to consider like for example how are you going to document that you gave authorization for this how are you going to document uh what the concerns were how are you going to document what uh the public feedback was on any of these decisions and so for this reason I have concerns with moving forward with it in this way because there is there there isn't anything included on this agenda as to how these decisions are going to be documented and made on the public record I don't think this is something that should have to be public record requested uh I think that it it should um be be part of a public record um on printed on a website somewhere and then in addition to that I do think that the recorder since he primarily has about 90% 80% of the responsibility in the statute over what this building is going to be used for for uh I think that he should actually have more say in this than Maricopa County itself even though you are the ones that are doing the building so uh so I'm disappointed in the way that this is moving forward I'm disappointed uh in how this is um being presented and also it's not true that you'd have to wait till the next meeting um as far as two weeks go you could schedule a special meeting anytime you want Mr chairman the reason the fact that you don't know that is another reason why I don't think you're fit to be in that position thank you thank you for your comments next speaker please Tom Arnold Lisa Everett Ryan [Applause] Heath some of my comments I would have had to read um and some of them were against the chairman so I don't feel a need to um reiterate those I just I'm not a lawyer you folks have who have all spoke before gave a very good presentation and I'm sorry I'm a little slow on the uptake at times when it comes to Legal ease but am I hearing that this doesn't give you all the power on this or any other issue that comes up it requires all the board's approval Mr ly would you answer that question please in the minute and 15 seconds we have left yes Mr chairman to the extent I understand the question um the board is being asked to vote on this agenda item number 60 to authorize the chairman to make ministerial decisions on a very narrow limited scope that is regarding utility easements to the property that means to the extent the County's going to invest taxpayers funds and building uh a new election facility that they have electricity and water and the toilets work uh and that's it and those checking off those things with the utility is ministerial no other power would be granted to the chairman by this vote okay thank you Mr ly can I finish on you you may sir of course okay I mean okay that's on this one again my understanding is any any in the future um this won't be an issue at any time in the future the board may agendize an item similar to this for other County Construction over which the board has 100% Authority no other elected official the county has authority over real estate or construction M thank you Mr ly thank you Mr Arnold next speaker please thank you Thea Everett Ryan Heath Roger mayup chairman galman and the rest of the board uh I wanted to just give a suggestion um Mark Stewart was kind enough to speak to me before the meeting and explain a little more in detail about this particular um agenda item and it completely put my mind at ease um maybe a little more explanation would help but I know for some folks nothing is going to help um the reality is it was mentioned you can call a special meeting at any time of course you know that what it takes to call a special meeting especially for something this minute is is really not feasible and not logical um this is just we want to move forward with this project in a timely manner as what I'm understanding and correct me if I'm wrong please do but we want to be able to do things efficiently and having to get everyone in a room to say yes you can do something as basic as dig a trench so that we can have utilities is I don't mean to sound rude but it's a waste of everyone's time um we need one person to have that Authority um sadly Mr Galvin um people have questioned whether or not you have the best interest of the public but the reality is you have the opportunity to prove that to us and one way you can prove that is not wasting everyone's time with special meetings and things like that but another way to prove that is what you guys are all doing here which is listening to me and I greatly appreciate it and I value what you do and what you bring uh we all have to learn our roles and we all have to grow in them but the most important thing to remember is that we all are maroba County Citizens thank you ma'am Madam speaker I'm Madam clerk next up Ryan Heath Roger mayup lesie Shepard hi I'm I'm Ryan Heath I'm a local attorney here uh I don't necessarily object to the ministerial action being vested in one particular Board of supervisor up here my problem is that with Mr Galvin in particular you have someone who has appr proven track record of not following the the most basic rules of these meetings and I'm pointing specifically to two meetings ago when Mr gallin banged his gavel and ended the me meeting unilaterally without any any vote without any motion without any Authority and if you can't follow these rules of decorum right here which say that if you have boisterous people in the audience if you have people who are disrupting the meeting and kicking them out then why would we Grant the authority to Mr Galvin to make such important decisions obviously toilet should flush light should come on but why this individual he's unfit and we should focus this power into someone else's Authority perhaps supervisor leco perhaps supervisor Stewart I urge you to consider making a reasonable decision based on the conduct of the individual sitting on the sport thank you thank you madam clerk next up Roger mayup lesie Shepard last speaker will be re Ray Michaels hello supervisors I strongly oppose agenda 60 this item would give more power to a chairman whose own political party recently issued a resolution of no confidence did you see what he did a few weeks ago stands up and talk about outbursts and and then you've got gardo too the king of outbursts stands up and just screams at people so you might want to start with the own Das first before you talk about the people who are actually your bosses but citing concerns about um the situation here there's been Authority abuses and violations of the First Amendment rights and the Americans with Disabilities Act the board has already lost court cases over similar issues supervisor Stewart thank you um sir thank I I appreciate your um your your I'm not done I have time left give you Supervisor steart has the floor he made a point of order for the counil legal counsel can we talk about uh item number 60 I understand the frustration from what's happened before but so we can get through this item and then and then vet that through um can you st I think your people right down here told you that is relevant to the person who is the chairman Mr ly Mr ly are we talking about ADA um no we are not and a the discussion about ADA and about any potential First Amendment um restrictions are not Germain to item number 60 supervisor Stewart thank you sir please continue that wasn't the heart of what I was talking about I was talking about his unfitness to have even more power with the power he's been given so I'll continue voting to expand his power ignores the party and your constituents I urge you to vote no on this two weeks ago I requested that when you come in here and you sit down that you would have the hope and the mindset of coming and obtaining redress the redress talks about a remedy that's the heart of redress not we come and address you thank you sir you need to try to obtain a remedy lesie Shepard last speaker Ray Michaels all right okay agenda item number 60 regarding um giving delegated powers okay the email I sent the three new ones last night was to show you the new executive orders that Trump wrote regarding election which has something to do with his agenda item number 60 what you guys are planning to do you didn't allow us to speak on some meetings ago we put in speaker slips regarding this election center and you didn't call us up and we didn't get to give you our opposition to it and now today you're trying to now give more power to somebody who's already been pointed out as being abusive and neglectful of the policies that even this room says should be in place the why is this important because when you three and I'm going to only talk to Debbie Lesco Miss McGee and uh you Mr Stewart when you decide that you're going to start going with situations that look good regarding our elections but the president doesn't even support what you're doing how I how do I know that he wants the machines gone he wants ballots he wants hand counts you should probably I wish I had this recorded right now Galvin at you as you're sitting here having your private little conversation with lyy your guys's little legal adviser but I'm just letting you know your choice to give this power to him I'm hearing what she's saying about the bathroom we don't have a problem with that it's who you're allowing to do it first of all you've disrespected your party that you've not even taken into consideration what they said and pointed out to you regarding his his uh shortcomings second of all you didn't even listen to any of us regarding this election center that we don't even need we have what money are we we saw it was like $19 million again you didn't let us speak on on this so you're sitting here now giving him a power over something that we already opposed Trump doesn't support so I'm trying to understand what would be the reason you would actually vote for this today other than your Defiance of your own party and your own president thank you thank you ma'am for your comments Madam clerk Ray [Applause] Michaels Ray Michaels uh Board of Supervisors and Servants of the people I'm so glad that we have this opportunity so in the law there is a principle of Delegation of powers delegation of powers is governed by the several legal principles that Define its limits and ensure accountability the non-delegation doctrine is a fundamental principle in constitutional and administrative law asserting that a body vested with legislative powers cannot delegate its core lawmaking function to another entity or singular person within a committee or supervisory position unless explicitly authorized by the Constitution or statute there's also the doctrine of subd Delegation which um states that a person or body to whom the power has been delegated cannot further delegate that power unless explicitly authorized the principle ensures that the original Authority remains responsible for decisions and actions rather than creating an unregulated chain of Delegation the rational behind this Doctrine is that the original delegator all four all five of you elected for a position to make this decision cannot give it to somebody else it could lead to delusion of responsibilities lack of oversight and potential abuse so no other power at this time I know that Mr lyy said okay well it's only a small bit of power we're only going to give him a little bit now but we could come back later and give more power now each one of you was elected by your District to make these decisions it may be easier it may be convenient more convenient to have one person do it but you are all responsible and you should not delegate the authority that you have received by everybody that you represent you need to make the decision you need to be there that's why you're here servant of the people that's why we pay you and again you do not work for the county you work for us thank you sir at the County uh supervisor Bry mcke I believe Mr ly header Mr ly yes Mr chairman the uh the non-delegation doctrine is not applicable to ministerial duties and this a board which has the power did not delegate its power for its core functions such as citation of the new building where it's going to be the budget for the new building architectural design and things like that have not been delegated but the non-delegation doctrine as mentioned by the speaker is not applicable to ministerial duties yes of course okay um supervisor Stewart thank you Mr chair yeah you know I I'm the last one that wants to centralize power on this board I think the fusion of power is how our uh Republic was set up right uh so we have these different checks and balances we have the judicial branch the Executive Branch the legislative branch frankly this is just a common sense uh motion and uh item on the agenda in order to speed things up speed to shelf to get this product built some people are comfortable with the product that's being built others are not uh we understand that uh this has been in process for a number of years and so um we just want to get this thing done before the 2028 election so this is kind of a common sense sort of process in order to speed up that process so we don't have to so we don't have the um the Builder the construction or the utility company doesn't have to wait two weeks for us to get together for me um you know I support this because I want to remove redundant regulations I want to remove the bureau Ry from government that that makes it hard for us to do business and do it quickly so I get 100% what you what everyone is concerned about as it relates to centralizing power this is not that this is a very mundane ministerial I like that word but um it's a fancy word but the reality is it's just a common sense approach to getting this done Mr Michaels you make a really good point right about following the rules and following the Constitution um this does not concern me in that regard this is a sort of a business decision like a CEO would sign off on something real quick to get it done versus bringing the board together and a company um so things can go faster I support that because I want to get this product done as quickly as we can Mr chair thank you thank you supervisor Stewart I think what we'll do is we'll take a motion and see if there's a second and then supervisors can make comments is there a motion for item number 60 Mr chairman I move approval of item number 60 as detailed on the agenda Madam Vice chair thank you is there a second I'll second that okay thank you there's a motion to floor any other comments supervisor letco uh thank you Mr chair I I support this I agree with supervisor Stewart this is a common sense we're not handing over a whole bunch of stuff to just the chairman uh Galvin to do anything Willie neilly this is very narrow and it's about utility easements for one building and um you know I I like what um uh lesie uh or at Leisa ever said it it seems common sense and so um I did want to address something that was brought up about how Trump is opposed to it I I highly doubt that President Trump even knows about this agenda item I mean I I served in Congress for almost please don't speak um from the audience um I uh I've served in Congress for about seven years I was one of eight Congress members that President Trump chose to be on his impeachment defense team I uh was endorsed by President Trump for this very position I highly doubt that President Trump even knows about this agenda item let alone opposes it and with that I yield back thank you um any other comments okay thank you I'm just going to make a few quick comments uh elections and elections Administration is really important not only to me but for this entire board our goal here is to have a new building in 2028 for the presidential election which I dare say will be the most important presidential election of our lifetimes because it's really going to determine the future of where this country is going there's going to be a fork in the road and what we want is for our election workers our election volunteers and our voters to understand that we're doing everything we can to put all the resources in to make sure that this building is a success the Board of Supervisors also have the power of the purse so this power we're talking about today this so-called power it's vested in the chairman it's not invested in any one person in particular especially not me it's for whoever is Chairman the other thing is it takes three votes of this board to make any motion to make any movement to make any action so if for whatever reason the chairman makes a decision on a ministerial or administrative action but three or more supervisors disagree they can move immediately to reverse that action to modify it to cancel it this is to make sure that this building is open in 2028 and frankly all five of us here in this board are excited for that day are looking forward to that day and we're going to do everything we can possible to make sure that that building is open in 2028 for the presidential election okay Madam clerk this I believe this requires a unanimous um consent for approval that is correct please call the RO thank you supervisor Stewart yes supervisor broy McGee hi supervisor leco hi supervisor Gallardo hi chairman Galvin I thank you all and this motion has passed and this item has passed we're now going to move on to another important matter for the Board of Supervisors an important responsibility something that we take very serious it's the appointments of vacancies to various positions most especially the state legislature so now item number 62 under Board of Supervisors appointment for state senator legislative district n um I want to thank supervisor Mark Stewart who has delved into this process which is not easy as I'm sure he's seen uh but he has handled it with Grace and integrity and uh Mr Stewart the floor is yours if you want to make any comments about this item thank you Mr chair yes it it was quite an experience and and I will have to tell you the the three candidates that uh that I was able to speak with and and then also uh confer with some of my colleagues about uh throughout the community um a number of positive I mean hundreds of positive comments came in about the three candidates and uh I am grateful to to ld9 for their selections as as many of you know um this is a uh Democrat seat in the Senate of our Arizona legislation um and a three qualified Democrats were put forward by the precinct committeemen of legislative district 9 in Mesa and uh we have uh it was a it was a difficult decision to make but uh pursuant to ARS 41122 we will be selecting Kiana Sears as our nominee for legislative district 9 in May sir that your motion that's my motion okay uh do we have a second supervisor gardo chairman yes sir thank you thank you first of all I just want to Once once again thank uh uh supervisor Stewart for his leadership I think uh you and I have gone through these types of legislative appointments I know they uh uh good three of us I believe I think it's yeah three of us that have served in the legislature we all agree the importance of this position uh the legislature is just so critical on on the work that they do it's a tough job uh but it's really important to have uh people that are on the legislature that are really really to willing to work to uh on the behalf of not only the legislative district but behalf of the entire State uh folks that are going to dive into very tough issues and be able to to Really uh work and Hammer out good pieces of legislation so I know all three candidates very well I know Miss here very well as as well all three candidates were qualified that's what makes these these appointments so hard um but yes I totally agree with supervisor Stewart uh Tiana Reed would be an excellent member uh in the legislature and I will second the motion and wish her the best okay thank you supervisor GTO Madame Vice chair and super letco you both served in the legislature any words of wisdom or comments for the uh for the motion thank you Mr chair yes I served nine years in the Arizona State Legislature it's a fun job so I congratulate Kiana SE seers um it's it's a lowp paying job it pays $24,000 a year they claim that it's part-time believe me it's not part-time just like they said this job is part-time it's not really part-time and um so I congratulate her I wish her the best it's a fun job it's an interesting job and I yield back Mr chair thank you supervisor let's go Madam Vice chair thank you I served 10 years in the Arizona legislature uh I have some words of wisdom I'm not sure whether or not to offer them uh probably given that I'm such an action-oriented individual uh my advice would be don't just do something stand there and listen I mean there's so much to take in do not be discouraged work work your hardest and meet with everyone who wishes to meet with you and you will be a better legislator and congratulations thank you all um the only comments I have to make uh once again supervisor Stuart thank you so much for your leadership on this important item I know you took this very serious I don't think I have seen an LD vacancy get more attention and interest than this one I received more phone calls from folks that I know than any other vacancy and we have done a lot I think in my three or four years here we've probably done 30 or 40 of these so you took on a tough one with three very strong applicants uh the other thing I want to say is that I submitted a questionnaire to these applicants as I always do to every applicant for issues that are important to me but also I think are important to the community one is about ethical standards another one is about the rising tide of anti-Semitism in our community which I find to be very disturbing another one is regarding housing which is an important issue in our community and another one is regarding elections I have been pushing for what I call a 95 to1 plan where I would like to see 95% of votes tabulated by election night for a variety of reasons all three applicants submitted answers to those questions and I strongly encourage you to go to our website and to see those answers and you can see the thoughtful responses that they provided in their own way but once again supervisor Stewart thank you so much for this and we really appreciate your work on it and Madam clerk um we're ready to go so if necessary okay Mr Gilbert I'm going to go to you first do you want to speak or make a presentation sir does the sun come up in Arizona he's been uh thank you uh for your record my name is Paul Gilbert 701 North 44 Street I'm here today on behalf of Bill dowy who is here and available to answer questions of Viking development and on behalf of the owner of the property van ptit land and livestock our request is for C2 zoning not only and I ask you to focus on this not only on C2 zoning but we're asking for C2 cupd the cupd offers a very important restriction on the otherwise open and Broad uses are are allowed under C2 zoning um the slide that you have before you shows the aial I apologize the piece of property is so small but it's right in the middle of the uh graphic there that we're proposing for the Mini Storage operation uh you can see Grand Avenue major thoroughfare arterial street is heading towards Wickenberg then you can see the central district of the Whitman community an unincorporated community and then at the bottom you can see the intersection of Grand Avenue and 2011th this shows the existing Family Dollar store along with the shell and pip vehicle and truck gas station with convenience store I point this out because it shows that there is a president president excuse me for commercial along Grand Avenue and what we are requesting is consistent with this President zooming in on the subject property now next slide please uh you will see still highlighted in teal the uh property and the surrounding development um I want to point out because one of the accusations of the opposition has been that none of this property of Zone C2 the red line that you see on the slide shows the dividing line between the C2 and the r rural 43 everything to the right is already Zone C2 so a portion of the property currently enjoys that existing zoning everything to the left is uh rural C2 importantly allows for a very intense amount of uses I'm going to just review very quickly some of them for you auto cells and repair retail cells gas Medical Offices um marijuana cells adult business hotels and the list could go on C2 is one of your most broadly defined uses for commercial development in your ordinance uh in fact the properties immediately adjacent and I ask you to focus on this please immediately adjacent to the Subic property have recently operated as an auto repair business and a bar and they are depicted on the visual next slide please to better show the small size of the parcel and the relationship of the proposed storage this visual adds uh in the site plan so you get a feel of what the mini storage will look like here and importantly you can see that access to the storage will be direct from Grand Avenue it connects Grand Avenue right in front of the property with a crossover thus affording direct access to the Northeast and Southeast we have prepared and presented a traffic impact study for your review and perusal uh we submitted it both to ad do and to mcdot ad do indicated no concerns with the proposal and mcdot approved the traffic state the traffic study impact analysis basically says there will be no more than an average of 25 trips now you count a trip as both in and out but there will only be 25 trips per day for this uh facility which is min minor minor minor juxtaposed against the heavy traffic that it faces along Grand Avenue um indeed uh the Mini Storage is one of the least most minimal traffic generating uses allowed in the commercial zoning the traffic will be lower than the traffic that could be produced on the C2 to the South and it is three to four times more traffic or less traffic than the retail would provide next slide please please here is a closer view of the site plan very quickly in the center is a two-story office building and residential building of only 500 square ft and then there will be a caretaker's residents as they will remain on the property 24 hours a day at the bottom right of the site's another two story building which will house the smaller side storage units with internal access the rest of the buildings and I want to emphasize this are single story so it's to minimize any impact on surrounding property access will be limited through the gates for to 8 a.m. excuse me to 5 uh p.m. 8:00 am to 5:00 p.m on Monday through Saturday and 8:00 a.m. to 2:00 p.m. on Sunday access will be available for those who have cards to the facility uh will be from 6 a.m. to 10 p.m. so we are also in conformance with the dark sky lighting provisions of your ordinance importantly the only lighting will be for security and that since we have very limited evening hours will mean there will be very little light produced by this facility I also want to emphasize next slide please the fact that we are proposing a cupd what is a cupd basically that means that we are restricting the property by the cupd overlay so you can't have the large prodigous amount of uses that are allowed otherwise in C2 you can only have have one use and that use is Mini Storage so we're not asking for the broad spectrum of C2 uses here we're only asking for a mini storage and that will be the only use that will be permitted under a cup to change that we'll have to come back and have a whole another hearing before the Board of Supervisors and not just super chairman Galvin um so uh basically we are restricting this use to one very limited lwi intensive use out of the large prodigous number of uses that are otherwise allowed in C2 next slide please here is uh a frontage road access for the Grand Avenue crossover here is the street view photo of ACC access to the property you can see that the Adon Frontage Road here which provides the direct access to the proposed self- storage operation why is this important and why am I emphasizing this the major point we want to make is that you have direct access to this property from Grand Avenue so there will be no need for any other traffic to go along the frontage road or to uh travel next to or adjacent to any of the surrounding properties this is simply direct access in direct access out and that's all that we'll be providing I think next slide please the context of this application is important as we reason together and on the screen are some uh context photos that these show the adjacent owner properties to the southeast with an existing Auto Repair building and a bar next slide please here are some additional photos that show the context of the property immediately next door to us I think viewing this uh vindicates the basic proposition that this clean limited traffic quiet use will have no no deleterious impact based on the existing context of the other uses in the area and we submit that this will be actually an improvement to the neighborhood again pardon my redundancy here but rc2 is restricted only to A Min storage that's all that can go there unlike the wide openen uses for the other C2 property of the South which can have any one of the uses that is otherwise permitted in C2 um I need to wrap this up uh let me just quickly talk about the opposition next slide please you have two letters of opposition from two adjacent Property Owners Unfortunately they have sufficient uh land area to trigger the super majority vote but let's take a look at the opposition very quickly uh the opposition the first opposition letter came from Mr Welch and basically I want to point out because I think this is important we're here and I'll emphasize this shortly in just a moment but we're here with a solid recommendation of approval from your planning staff at the Planning Commission hearing this letter of opposition was submitted despite the existence of this letter of opposition the Planning Commission chose to keep this case on the consent agenda which is an unusual occurrence why because this case the merits of this case were so pronounced that the Planning Commission did not feel it needed to be removed from the consent agenda even though there was this letter in opposition so I'd like to review the opposition's points first that it will affect the rural lifestyle um you can see from the context photos and have your own opinion as to whether that's a rural lifestyle out there next door to us but I think the context photo shows that we are an improvement and furthermore there is nothing that a small min storage would take away from a rural lifestyle next where con the concern is raised lights at night and the we point out as I did before the lighting will be uh limited to simple security and we're not a 24hour business and we will comply with the county dark sky regulations next we'll block the views as situated we have only two small buildings that are two stories the rest are one story there's no empirical data suggesting we block any views uh next that we will add vehicular and foot traffic take the ladder first I don't know of many many storage facilities where people come to put their facilities or their their furniture and what all in the facility that come on foot so I don't think there will be any foot traffic to this Min storage secondly we don't add significantly to the vehicular traffic we've submitted a traffic report that vindicates that and that traffic report as noted earlier was reviewed and approved by mcdot and then the last one is I'm sorry two more noise at all hours of the day as noted the hours of operation are limited and we don't produce noise that's one of the beauties of a Min storage operation it's a quiet self-contained operation last they point that there will be a problem with air quality due to the vehicular travel we've already pointed out to you and supported by the review of mcdot that we're not producing a significant amount of traffic I can see the Chairman's getting nervous so I'll try to wrap up all right I was reading your fingers there like you were saying hurry up okay you wanna you want to wrap it up Mr I will wrap it up all right I won't go through the other opposition letter but basically it's much frankly a repeat of the other concerns uh two slides forward please we simply want to point out that we are in this planning area of the city of surprise they have given a letter of support we are here here in the posture next slide please we are here in the posture of a recommendation of approval for every single reviewing agency the staff is in support we are in agreement with all of the conditions in the staff report the Planning Commission voted unanimously to approve the case so we have the city of surprise the planning and development department and the Planning Commission in support as staff notes in the report now conclude with this while the area still encapsulates rural development the proposed use here's the quote is benign enough to mix well with the existing rural nature staff also adds that there is a great need for this facility there are no many storage facilities in the immediate area in conclusion we feel that we have a very strong meritorious case and we stand before you in the posture of having approval of virtually every recommending body be happy to answer any questions that you may have thank you Mr Gilbert any questions from the board I see none okay Madam clerk please call up the one speaker in opposition Mr David Hunter thank you board for your time uh my name is David Hanner and I wasn't one of the objectors per there so perhaps I'm a bit late to the party but I have a very vested interest what he led you to believe was that the prop the parcel was directly along Grand Avenue that's not correct there's parcel 503 420g my parcel which stands between Grand Avenue and the proposed building site he talked about all the support that the the government bodies have but the reality is none of the neighbors that it's going to be affecting our day-to-day lives are are in support of it you've seen the other objections and perhaps there's disagreements with what they were objecting for again I feel a bit late to the party this is the first time I've had an opportunity to express my objection but it's a very small site and he talked about it being partly partly C2 the reality is 95% or more of that parcel is our 40 3 there's a very little sliver in front that's C2 but the overwhelming majority is r43 its original intent to be residential I own the parcel not only along the front between Grand Avenue and the site but I also own the parcel uh on the other side which extends both on the other two sides so that's three sides of the parcel that would be encapsulated by two lats that I own and then Mr Welch owns the home next to them he talked about the garage and bars if it's still an active business that's long been shuttered the reality is there's no commercial business in that that area it's very it's very residential it's very quiet um again all the neighbors are objecting it has very limited Ingress and egress to the parcel itself um and I just wanted to express the fact that it's not supported by the na neighbors it's very enclosed where it is talking about two twostory buildings in a commercial presence in an area that doesn't have a commercial presence I'm very supportive of develop and surprise very supportive of more storage capacity being built out there but this isn't the right spot it's nestled into amongst a multiple private Lots it's not directly on Grand Avenue it's not directly on the Frontage okay sir thank you so much for your comments we appreciate you coming down um supervisor alesco I believe this is in your District do you have any comments or would you like to make a motion yes I have both um and so I I want to thank um both U people that spoke today um I don't know if the rest of the supervisors know or the people that the opposition spoke this was originally on a previous agenda it was going to be on a previous agenda and I asked it to be delayed till today so that I could get more information because U Mr Hanner I read your opposition letter I read um Mr uh the Welsh's family opposition letter and so I needed to know more about this and I take uh the opposition uh seriously um and and so I that's why I got more information and um I'm a I'm a there has to be a balance I'm a huge believer in property rights uh and so I have to think about this and like okay like if we um if you were before us Mr uh Hanner or Hanner I I'm sorry I don't know how to say it um you know and you wanted to do zoning you know would how would we vote you know we have to think about private property rights but does it also fit in the area um and I do believe it it fits in the area and I have taken this seriously I've reviewed it I've spent making sexually explicit content available to minors as a criminal offense calling it educational is an act of negligence at minimum today you three new board members no longer claim you didn't know one year ago at minimum gardo and galin were made aware almost a year ago today and you three have now been made aware in public record that books containing sexually graphic inappropriate content are accessible to children in institutions that receive County funding which means continuing to allow this is not accidental it's knowing and that puts you in direct violation of the statute you are now accountable personally and professionally the law holds accountable not only those who who hand the material to a minor but also those who knowingly make it available through negligence or policy failure the people are watching the parents are watching attorneys are watching take action now audit the content update the access policies and remove these materials from children's sections do it before someone else has to force you to thank you thank you Mr Adams Madam clerk next up Leslie Shepard followed by Roger mayup then Ryan Heath I'll speak in on item 65 okay okay so now what he was talking about this right here is a book called it is perfectly normal a year ago we brought it to every one of the board members attention this book says that it's for tenant up on the spine it says children Department this right here on page nine it shows you how to have graphic sex a male on top of a a a female on top of a male here we've got two women straddling each other getting it on in bed page nine here we have two guys getting it on in bed page nine 10 and up ARS 13357 it says one thing in there that I noticed they use as a scapegoat it's called educational purposes I'd like to take you then to page 89 page 89 literally says where are you at page 89 oh it describes what pornography is in this book it says says you may on sites such as photos or videos of naked bodies or sexual acts that are created to make a person feel sexy excited these kinds of photos and videos are called pornography this educational book let you know this book is pornography um right here we have a book called this book is gay this right here shows you how to have boy on boy sex it lets you know where to stick it where it licks and where it feels good these are our children's Department these are actually in some of the schools as well this is under your peripheral you know this is the very example that I gave the Board of Supervisors when it was brought to their attention a year ago is that it's kind of like a drug dealer you can sit here and talk about the guy with the baggie but who gave him the big junk who gave it to him to go out there with you guys are the suppliers of this if you don't put restrictions on what is in our children's departments in the libraries whether it be public or or uh schools you are now responsible cuz I'm letting you know what's happening I would take whatever effort you need to make to make sure they're safeguards in place question second time Galvin uh Miss shephard I have a question for you before you leave thank you thank you for not getting mad at me now that you've addressed me and I'm going to respond to you go ahead I'm just saying that because steuart addressed me about something we asked him to pull some agenda items and he didn't supervisor let's go you have the floor thank you um Mr chair and Miss Shepard can you repeat the names of it is perfectly normal it is perfectly normal and what Maricopa County uh operated library is that in um well it went on record on the uh 10th of April letting them know it was up in Anthem Anthem okay I don't have access to all the libraries so I can go only go by what people share I know that I can go to a public library a County public library right now I can walk in the children's department and I found all of these which and Mr chair and which one which Library any County Library you can look it up if they don't have it in the one near you you can look it up they'll send you to another location answer my question I just wanted to know I'm trying to understand okay so you said you found it in the anthem library is that cor no I told you that a parent went on went on record on the 10th of April of last year stating that it was in her child's when I was bringing it up to them showing the page and what was in it and absolutely nothing has been done about it since then other than a reference of saying it's educational material so that's why I took you to page 89 of that educational material and showed you that educational material let you know that it's pornography thank you this is a an a subject that I really care a lot about in Congress I formed the protect our kids caucus and so I I want to help so don't be so ADV serial please well the only reason I said that is because of the way you acted with me after I spoke last time is talking supervisor is talking she's ma'am would you please be respectful I'm trying to help okay please and so you called me adversarial I thought I'd address why was an unnecessary comment okay go ahead I don't think it was unnecessary you're just SC you're being adversarial all right you comment me after I I I have no more questions thank you supervisor let's go supervisor Stewart this is thank you chair I I think we can maybe head this off a little bit here we listened to the public we had a conversation we had a meeting on Monday about um these particular books in our library um it's in process right now to put forth a program that protects our youngest uh minors our children from having access to these books we are not going to ban books but we are going to put something together to make it appropriately put in the library so that a child has to either check it out get permission from their parent it's just a common sense approach um we heard you loud and clear um it's something that's very important to me as well I've been working with the Queen Creek mayor on this particular issue it's just a process to make sure that we follow the legal ramifications to protect the First Amendment and some other things as it relates to the law so it's in progress right now it moves at the speed of government we have to make sure that we we dot all the eyes and cross all the tees but I just kind of kind of head this off a little bit we are working on it we appreciate you bringing this forward um but thank you very much much Mr thank you madam clerk chairman next speakers on item 65 Roger mayup Ryan Heath last speaker will be Louis margara thank you Mark for addressing that and on the opening prayer it said that you would be guided by God I think this is just like you said an insane situation that this has even come to hear so here's what we're asking with regards to that that you immediately initiate a Content review of the youth sections for all public publicly funded libraries and schools we can provide a list of books that have been removed from other children's sections as a helpful mechanism to protect the children's innocence and to protect our County from being sued as the public is becoming more aware of this crime against children two segregate inappropriate content from the children's department and restrict access for adults only three establish a parental oversight committee to guide and review materials four train staff and Leadership on the standards and the legal boundaries outlined in ARS 133-35 7 five suspend and redirect funding from any institution that refuses to comply this is now a matter of legal liability it's not our opinion failing to act from this point forward will not be viewed as negligence it will be viewed as an intentional violation please seek to obtain a remedy as you are required to under the Constitution thank you thank you sir Madam clerk Ryan Heath and last Lou Mar Garza I just want to start by saying thank you to supervisor Stewart and supervisor leco for uh expressing their willingness to address this issue in particular uh in my view I just want to point out one thing this has been reported to the mayic Copa County Sheriff's Office this particular issue it is in violation of a criminal statute which makes it a class five felony I believe don't quote me on that you can look up the statute yourself but the problem with this so far is that the board is getting advice from a from Attorneys at the Maricopa County Attorney's Office who are also responsible for prosecuting these types of crimes in this jurisdiction it's called the conflict of interest you should find someone who is independent to give you advice on these types of issues independent legal counsel so that you can appropriately address them because why would a prosecutor who's also responsible for defending the Board of Supervisors bring charges against the board of super that makes no sense so all I ask is that you please consider in addition to what you're doing now finding outside legal counsil perhaps even appointing a special prosecutor to take on this issue uh the books we're talking about are completely inappropriate I can't even read sections from these books to you right now without risking getting kicked out of this meeting that's how bad it is so I advise you to take this very seriously I appreciate the steps you taking and please find independent counsel because the mayor Copa county attorney's office is not representing the interest of the the public on this issue it's protecting you from liability so thank you madam clerk any more speakers on this item last speaker Louis Mar Garza okay hello Mara Betty Garza I am here with reference to item 65 library donations I want to make sure that in these library donations that none of these books are accepted first and foremost and if they are that you send them back to the people who brought them to you or just burn them because if somebody's getting rid them in your from their household to yours to pollute yours get rid of them secondly the only reason you had a meeting on Monday is because certain individuals have been behind the scenes making sure that you're aware of what the law is and in this particular one that you had a attorney client privilege meeting that none of us could attend to State uh regarding the responsibilities of the uh Library District with reference to uh this uh I guess this objection we have with these offensive books to that end I'm going to read to you ARS 1350 13357 makes it clear it is unlawful to knowingly furnish or make available to a minor any harmful items that is obscene or sexually explicit in nature you are complicit in this whatever you decided on Monday without our input but now here you're suggesting that we're hysterical about this this has been one year in the making and suddenly somebody's interested I don't care if you haven't been here before you've been 8 here somewhere else make sure that you understand the downflow of what's happening in your local community and I can assure you Trump is very much aware of what's going on in Maricopa County you have been pinpointed and I will say to you I believe I have my my last one here to the library district I am a patriot I am a mother doing my duty in Saving the children are you in plus page nine or are you out of this and even though that I am just visiting I am telling you Mr Trump and the whole crew is keeping tabs on you they shall make an example of you thank you thank you madam clerk any more speakers chairman no other speakers okay chair supervisor Stewart you know I think this is good feedback from the public and I think that's why we had the meeting that we had on Monday is because the eyes and ears of our community shared with us some concerns of what's going on with some of the Publications that are in our library and the the board is taking action um the good news is is that I think we've come to what we think will be a a very uh good solution to this issue that that manages uh First Amendment rights but also manages protecting our children in our schools I do want to note that um many of these Library districts are also intertwined with the school districts it's a way to save money we have that in Chandler and in some instances you may need to take this up with your school boards or with your principles at those schools if these are issues that you have with those particular schools and school districts uh we will work diligently on libraries that we're responsible for in the in the county to protect our children from reading things that just aren't appropriate for that age I me what do they say Our Brands aren't developed until we're 25 or something like that I especially maybe maybe when you're 54 like me but we're learning all the time we appreciate the feedback because this gives us the ability to take action so look at it as a symbiotic relationship we get information from the public whether that's a developer or whether that's you uh we take that information in and we're going to try to do the best we can to provide the best service to the community so thank you thank you supervisor Stewart um the we'll take a motion and then we'll do comments is that okay so the board will now consider a motion for items 64 and 65 Mr chairman I move approval of items 64 and 65 uh donations to the library district as shown on the agenda I also have comments terrific is there a second second okay thank you supervisor Stuart supervisor Alco you have comments yes thank you Mr chair even though this particular agenda item number 65 was about the donation of 10 what park use permits or something it had nothing to do with with um explicit books but I want to emphasize again um that I take this very seriously and so anyone that wants to uh I already talked to people in them planning to set up a meeting with a small group of people uh on this subject uh with our staff um and what I guess I need is for people to say okay exactly where you know because I I quite frankly don't have time to go to all the libraries and look where these books are but exactly where are these books are they still there are they still in the kids section um from CU from the initial uh um things that I've seen there was several of them that are still in the kids section um and so I just need to know if they're still there where they are and I need your help uh to do that and so um I I do take this very seriously and I want to if there are sexually explicit books in Maricopa County libraries for children they need to be moved or removed and with that I yield back thank you supervisor uh Stuart or broy McGee Madam Vice chair uh thank you Mr chairman I must state that as a mother and a grandmother uh I would not want my children having access to these books uh it is so unfortunate over the last couple three years that this wish to remove or restrict access became labeled book Banning thank you for pushing back and calling it what it is parental control over what their child is able to access and read in uh in the public libraries I am looking forward to working with my fellow supervisors to revise our library po Library policies regarding access built around ARS statutes about exposing minors to obscenity uh and built around those statutes and at the same time being very respectful as we must be to access in the first Amendment as a point of clarification no decision was made nor could it be made in executive session this item came to the agenda because board members expressed concerns and they wanted legal advice on how to proceed because as always around issues that are contentious hard for me to believe it's contentious but they are then the threat of lawsuit is triggered so we want to be very thoughtful in our approach uh very um judicious and how we get there but as a parent I determine what my child learns and sees and at what age and that's the way I've always been and thank you Mr chairman for allowing me to comment thank you supervisors and thank you all for your serious dedication to this issue as the county manager knows this is an issue I've been particularly interested in since I've come into office and of course there are complicated issues here at play uh the wonderful thing we have is our US Constitution and the First Amendment and I think the last thing that anyone wants in this room or especially in our wider Community is government regulating content of speech and so that's why we have to be particularly careful because if the five of us are not here what would happen if five other board members came in and wanted to regulate books that we like or that we appreciate or we that we cherish so obviously we have to be very careful but at the same time we have to be mindful about protecting our children protecting Innocents this is a very harsh society and as the parent of a young son my wife and I do everything we can to protect him and I've spoken about this publicly I've spoken about this from this bench but I've also spoken about it in TV interviews it comes down ultimately to parental responsibility there are many ways that children could be exposed to harmful content to you know for me personally sinful content it could be at a library it could be on a TV screen it could be on an iPad and it could be even at the cell phone which all of them have access to at a moment's notice with a parent or another family member or even older sibling but what I can assure you is that we're going to do everything we can to comply with the law and we're going to do everything we can to comply with the law but at the same time being mindful of our priority which is protecting children the other thing I want to point out is that this is item number 65 donation to the library district for the 202 for 2025 winter reading program overall we have an excellent fantastic library system that is enjoyed by kids and especially senior citizens and I'm very proud that we have a library in my district in Fountain Hills and I'm very proud of the fact that Maricopa County works with municipalities throughout on making sure that we have an excellent library system and I want to particularly highlight this item today because I do think even though it's small it's wonderful it's 10 single day used Park entrance passes from the Maricopa County Parks and Recreation department and once again it just shows the wonderful interplay we have here at Maricopa County and I want to particularly thank our Maricopa County Parks division for doing what they can to help our County's winter reading program it's only worth $70 but we know that anything that helps last election and they indicated you'd be a sener and inventory clerk they would train but whether you're counting ballad affidavit envelopes in what has been brought proposed to you one day one vote we don't need early ballots they have confused the process and also it was said people keep saying that the 2020 election was fair but we do know there's some something really really peculiar we never looked into it was Sharpie gate but that was put down but the over votes and interestingly enough our chief justice and a couple of other justices their chief justice is either retired or resign brell I voted on Election Day and I was an overvote because they said I voted twice for him they got more votes than either Trump or Biden finally people that don't like Doge it was a bipartisan asking this with one of the ladies that was here last last time time we came here and we were s sitting up in the third floor lobby of the Senate building waiting for Senator Farnsworth to come out and get us because he told us we can come down and visit him anytime we want and uh and another senator who I I won't mention a name right now was walking by and I know him because I collected signatures for him and stuff like that and uh and I says uh hey um what about your your falsified property D's um case you got with that that other person in a different state and uh he says we're just waiting on a a um us appointment with the US attorney and then I asked him I say what do you think of Thomas Galvin he goes ah that guy's a crook and a criminal and uh and then uh two I was uh I was at the um Town Hall about a week ago yesterday and I asked Jerry Sheridan in front of everybody if he had room in the Maricopa County jail for Thomas Galvin and everybody in the room erupted thank you 2020 it's not over and that's supposed to require a 24-hour uh notice in advance and yes uh when it comes to Ada forms that would be a 48 hour notice but those forms um was supposed to be at this meeting which even uh Christopher Reams even uh said that that would start being uh presented and and it is not um and so we could uh go into the counterargument that should be here guys um and uh lastly I would like to say that I submitted agenda items for 20 and 39 which uh you did not uh state that those agenda items were submitted um when it comes to Robert's Rules of Order the thing is is we're allowed to uh be I do think that we should have some more back and forth especially if someone is addressed in the audience you are not our overlords so um I would like to register a vote of no confidence in Thomas Galvin um and I ask that one of the new appointed members take his position please um it was wrong of him and very disrespectful the way he ended the meeting uh on February 26 and um did not allow anyone to speak at that meeting uh also the old board and Stephen Richard came up with an agreement that changed the county quarters responsibilities and that was totally unprofessional and not we voted for the County recorder and so his his duties should be restored to him that's just common decency and so you know I think all those people involved with that should never hold public office currently in the Maricopa County Library System I verified this online they're either available physically or digitally so please check your email let me know if you have any questions uh number two uh supervisor McGee uh you had said that you like to take meetings with your constituents and I had uh reached out to you by phone several times um and also text message to uh talk to you about some issues so I I'm looking forward to being able to have that conversation with you um supervisor uh uh chairman Galvin uh you said that you care about the First Amendment yet today you prohibited a number of public comments on items that people had submitted specifically that uh do not prohibit non-citizens from accessing the housing programs that you voted on today so that's very concerning but more concerning than that uh one of the biggest reasons why I said you're not fit to lead is because I public records requested the records after you claimed you had had weeks of ongoing conversation with the recorder um and his staff and your staff and I found out that that statement M was blatantly false um I put out a text uh or a tweet thread of those conversations and the timeline of that and you actually didn't even request to have a meeting with uh the recorder until 40 minutes before your statement was released to the public uh and so I find that concerning uh because you are in the public perception representing the rest of the supervisors and you're not communicating accurate information to the public you had actually you and your staff had actually pushed off meetings for several weeks um with the recorder and his staff and so if I just don't think that you're acting in good faith I think that these public records prove that you're not acting in good faith and if you're going to lie I don't know why Madam clerk Joe hop lesie Shepard then Tom Arnold good morning um like Christina Tyler I filled out two forms earlier today when I came in to request to speak on two items and once again now for the fourth time I'm being denied the right to speak however I'm here to remind this board that denying reasonable access to public participation has been ruled unconstitutional in multiple fed Federal cases in is versus Madison local school School Board District Board of Education the sixth Circuit Court of Appeals found that restricting public comment based on tone or criticism was a First Amendment violation similarly the Liberty Justice Center filed suit on behalf of a North Carolina resident silenced during a public meeting by his County Board these elections these actions were deemed unconstitutional restrictions on speech these precedents should be taken seriously the law is clear public bodies cannot impose arbitrary rules or barriers that exclude residents from speaking whether by inaccessibility cancellation or denial of remote participation this board has a duty to uphold the Constitution and the Americans with Disabilities Act continued inaction invites legal Challenge and public mistrust vote in private count in public hand count paper ballots one day voting thank you thank you sir Madam clerk lesie Shepard Tom Arnold Don I'm just hoping that you're not for that reason that he's endorsing you so please don't use your titles when when we get done speaking to dismiss even when you made that comment when you said about well this was a library agenda item and it was talking about a budget you just we have to use certain ways to talk with you we can't get meetings I've asked to meet you with you I've asked to meet with Miss McGee and I've asked to meet with Miss Stuart I've reached out to Thomas Galvin twice since the beginning of this year he's got a wonderful assistant Michelle no meetings whatsoever and and Mr Stewart when you're coming up to talk to us I appreciate that you do come out and talk with us but before the meeting we're at go time because we have an arbitrary rule that's in place that makes it to that we have to have everything turned in within 10 minutes of the meeting beginning and we don't even know if you're going to call the agenda item which is what happened today several agenda items were not called today because Mr Galvin has put them under consent agenda to make them off limits last year no consent agenda items were off limits that began with you Mr Stewart and even then there was only net an average of 10% of the items put on consent agenda still not off limits now you're at 50 60 and today 72% of agenda items are off limits to the people so if you sense hostility it's because I'm trying to talk with you within in a two-minute period and I've tried to talk to you outside that I'm not getting it and so when you guys get to make your comments when we're done it seems reasonable next up Tom Tom Arnold Don hayatt Ray Michaels hi part will be read and part comes from my heart I'm here today representing the thousands of working citizens in Maricopa County who simply cannot attend these meetings during regular business hours many of us work full-time jobs have families or caregiving responsibilities expecting working people to sit through hours of proceedings just for a two-minute chance to speak is not reasonable or inclusive and when public comment gets cancelled our only opportunity to be heard disappears remote access through webinar would allow more people to participate in our Republic without sacrificing income or family obligations this board represents nearly 5 million people that deserves broad access not barriers please do the right thing and open up public comment to everyone when Leslie gave me this it kind of pertains to me because in June I get a new knee and I will be unavailable to attend here because I I can't I won't be able to walk so it would be nice if if I could have access to the meetings via if it's not already available um miss leco you took my committee's man's place and I haven't had a chance to meet you yet I look forward to doing that and I'm hopeful that your door will be open and Mr Stewart I appreciate you coming down into the um to visit with us you seem it seems to be us versus you and you're doing that I don't sense that I sense you are a part and hopefully that will be more open for come and and um share time with us please thank you sir Madam clerk BS versus you Don hayatt Ray Michaels Ryan Ryan Heath chairman Board of Supervisors I'm going to read a resolution and whereas the Maricopa County Board of Supervisors are elected by the people to represent the people and are responsible for con U conducting meetings and the people's business in a fair prepared transparent and accessible manner ensuring and encourage public participation in governance whereas in a representative Republic the top priority Duty and responsibility of an elected public a servant is intended to and should be to respect the wishes and voices of those they serve whereas beginning in 1625 Thomas Galvin as the newly elected chair has demonstrated his lack of of care compassion and self-control to properly execute the leadership position with an with an unwillingness to hear the voices of the people in his handling of board meetings and working with fellow elected servants whereas chairman Galvin has en enforced unre reasonable meeting rules and regulations thereby denying members of the public their right to speak during public comment whereas chairman galman deliberately placed his public comment at the last agenda item thereby forcing the people to wait excessive amount of times before exercising their guaranteed First Amendment right to petition its its government for the redress of grievances whereas chairman Galvin was unjustly denied a dis disabled individual the ability to whereas Galvin unjustly denied a disabled individual the ability to speak in place of an individual who had time timely um submitted a speaker slip and I'll stop there at this point Thank you thank you sir Madam clerk Ray Michaels Ryan Heath Roger mayup Ray chairman Galvin it was inappropriate for you as chair to previously call me out by name and warn me not to speak out and disrupt supervisor Lesco for the record I did not speak out in any way nor did I disrupt supervisor leco I will continue where ad Don Hyatt left off chairman Galvin arbitrarily and without the standard protocol of a motion or a second unilaterally gaveled out of a meeting abandoned his post demonstrating a blatant disregard for his fellow supervisors a procedural integrity and public participation whereas chairman galin has failed to conduct himself for the benefit of the People by not working with fellow elected Maricopa County Recorder Justin Heap and establishing a timely shared services agreement whereas chairman Galvin has shown a complete disregard for his elected position as a servant of the people and has consistently proven his inability to Pro properly chair the Maricopa County Board of supervisor meeting nor does he acknowledge or affirm that all government is created for the benefit of by and for the people therefore be it resolved that the mcrc EGC has a vote of no confidence for Maricopa County Board of supervisor Thomas Galvin as chairman for his failure to uphold the principle of fair governance public accessibility proper meeting conduct election integrity and an inability to control his own emotions exemplified in the February 26 2025 Board of supervisor meeting be it further resolve that the mcrc EGC demands newly elected Maricopa County Board of Supervisors hold chairman Thomas Galvin accountable to his previous actions and elect a new chairman who is a servant of the people returning to the high standards of leadership and restoring trust transparency and adherence to the established Rules of Order in all future decisions be it further resolved that the Maricopa County Board of Supervisors immediately reinstate the former shared services agreement used by the previous two Maricopa County records in complete cooperation with the current current Maricopa handy recorder Justin Madam clerk Ryan Heath Roger mayup Lisa Everett all right I am here on behalf of my client Don height how many of you know what this is De letco thank you it's a walking measurement device uh I was here actually last week on Friday and I took the time to measure the closest handicap parking spots to this particular uh building the closest spot is 940 ft away in order to get to that spot which is on the corner of Third Avenue in Washington one you have to pay two you have to cross multiple railroad tracks for the light rail if you want to park for free as a handicapped individual you have to go more than 1,300 ft to the parking lot down the street here that's not a reasonable accommodation so I'm here to try to avoid litigation because I am contemplating suing this board for violating the Ada this can be easily resolved get a light post in your free parking lot with a button on it and buy a golf cart the button gets hit send a sheriff down the street to pick him up couple thousand dollars problem solved no lawsuit now the other thing that I want to point out is there is a an issue here under the equal protection Clause of the 14th Amendment now you're not necessarily discriminating against a protected class of people but there is a Doctrine called the class of one Doctrine and what you're doing right now is you're actually allowing people like Steve gardo to appear remotely but you're not allowing the public to appear remotely the public in every other county has the the opportunity in Arizona to appear remotely for public comment but not in this County it's an arbitrary decision and it violates the equal protection clause and I can sue for punitive damages and you should take this seriously every time I file a lawsuit against this County you have to hire snow and Wilmer to defend it because the County attorneys are not competent to handle the lawsuits that I bring so in conclusion I just want to say take some steps make some reasonable accommodations for people who are disabled veterans individuals who want to provide public comment or there's going to be a lawsuit thank you thank you madam clerk thank you yep uh if you can direct your comments to either the chair or the county manager uh County Manager can you work with the city of Phoenix on this Ada issue um I know these are their streets out front as well as their EES mins and find out uh if we can get some better access a few parking spaces or issues such as this are in consultation with our attorneys correct Mr chairman that is correct okay thank you madam clerk thank you next next up Roger mayup Lisa Everett Louis marar thank you Ryan for those comments and the measurements so you've now heard from people representing the disabled the working class and those citing established federal legal precedent what we are asking for is not extreme we are simply asking for lawful equal access to public meetings through remote webinar participation the refusal to make this option available despite multiple requests from disabled constituents despite legalis and despite the needs for Working Families it's unacceptable this board represents millions of people yet continues to operate in a way that makes public engagement harder not easier accessibility is not an inconvenience it is a legal and moral obligation denying that access doesn't just silence a few voices it undermines democracy for everyone the solution is simple turn on the webinar it's just like that turn on the webinar make a public comment available remotely protect the dignity rights and the voices of your constituents we are watching we are documenting and we are not going away please do the right thing and seek to obtain a remedy as you're required to do Under the Constitution and miss leco your remarks about uh responding to Leslie about the uh president Trump not being aware they're condescending and you were disrespectful so if you don't want any kind of adversarial deal then don't just pop off at the end about this is just kind of idiotic that Trump would be involved in this so I would ask you in closing would you talk to your boss that way because you just did thank you sir Madam clerk Lisa Everett Lou margara Courtney condrick chair Galvin and members of the Board of Supervisors thank you for allowing me to speak again um I wanted to let you guys know the audience mainly I did send an email to you guys and I am greatly appreciative for the response from you chairman Galvin and I actually uh got a phone call from Debbie Lesco and I really do appreciate that a lot um a suggestion for the new elections building um we have a former uh a former election official and we have a excuse me recorder and there's also a supreme court president naming a principal after this person and her name is Helen purel and it would be kind of a good idea I think if you consider considered naming the new building after her but uh that's just a side note um about deorum I am an LD chair and I have experienced a lot of intense meetings and sometimes most of the time it's on both sides the public feels that they're not heard but the public often is a approaching this and I will use your word adversarially angry screaming into the microphone and I know that they may have spoken many many times before about the same issue but that's not going to get anywhere also it's it's kind of frustrating that sometimes we don't feel heard sometimes when we speak you guys are not paying attention I will say that that has not been the case at this meeting um it's much better it's improved so I greatly app appreciate it um and I know that everyone just needs to come together and work together because let's face it we all want what's best for our County um I want to thank thank you Miss Everett I'm sorry time's up Madam attorneys regarding the library district issue um and you didn't want me to speak on number 15 which was the appointment of 13 new County attorneys that you've just had them sign an oath to and under that I would like to read what you had them ass sign an oath too that in in the um during their employees term or office of employment they would not commit any act to overthrow by force violence or terrorism as defined in the section the government of this state or any of its political subdivisions I am sick and tired of asking and sending um emails as to what is a definition of a political subdivision because you have 13 new people Han Mia Natalie Ella Dylan Savannah Teresa Benjamin Elaine Samantha Amy and Kevin right now they are County attorneys and so I ask each of you do you declare by loyalty and felty to a restore the public your dedication am I on two minutes well I well you got to start it because it's been day day day hold on I actually think you have do not interrupt what my time is have them do it correctly I'm trying to help you I actually think you have more time I just think Mr chairs the clock wasn't working I've been following it and I so I have the time and Galvin and thank you Board of Supervisors for your concern about the sexually inappropriate books in the county libraries my name is Courtney condere and I am the director of operations for Arizona women of action and um I'm here to Echo the concerns of supervisor leco and supervisor McGee um and respectfully request that the Board of Supervisors carefully review the books placed in the children's and J juvenile section in the county libraries and move any inappropriate and sexually explicit books to the adult section this puts parents in control of what their child is exposed to and this this request would not ban any books but would give parents the control to check out books for their child that they feel appropriate and align with their values there is a list of roughly 280 books that Miss Hamilton referenced and I believe she said she sent them to you um that have been rated by book logs as a three or above meaning that they are either sexually explicit or inappropriate for children going to the library is a great activity for parents and children to do together especially during the heat of the summer to get out of the to get out of the Heat and myself and Arizona women of action want to ensure that the selection of books offered to kids are educational entertaining and appropriate without having kids or excuse me without having the parents have to worry about what their child is reading while they're in the library please review the list provided to you and we look forward to following the progress being made by the Board of Supervisors to remove these books from the children's section thank you very much thank you ma'am Madam clerk last speaker speaker blue Crawley how yall doing today and hope that everything is fine with you it's Transit again I've got here the uh document of the prop 400 what the county is doing and if you look under uh Safety and Security for all the 25 years of the program prog you spent zero so I find it's fascinating that over there at Valley Metro Rail that they're going to be spending $103 million on security over the next 5 years and like I said I don't need you to be taking that money out of prop 400 but then even better I noticed that their last uh study session and that they're expanding and uh what it was is to uh conduct Operation Blue ride which has Chandler Mesa Phoenix tempy and Mesa all having police officers now on the buses I have a real problem with that CU unless that officer is there to see me specifically or anybody else I don't want him on the bus that's it's unconstitutional it's in all kinds of ways negative but they're doing that and trying to progress and it also says on how much Safety and Security they have been spending the the next one down it's bus stops and do you know how much y'all spent over the 40 years on bus stops zero so when it's infrastructure and I believe that's a part of the Safety and Security part since if it's 117 in the shade it's almost 10 60 without that shade there of a bust offit so I need you guys to bate the agencies Rail and that and I'm we'll cut thank you blue and thank you everyone for public comment thank you as always for coming down here and please stay safe outside we're now going to move to supervisor comments and I'm going to start with the county manager and then I'm going to work right to left with district one County Manager borski nothing today chairman thank you okay thank you supervisor Stewart thank you chairman and thank you to the public for being here you know I was talking to somebody the other day about um how these meetings are run in other countries and uh when people from another country attend these meetings they're absolutely Amazed by the way uh we can communicate with one another in these meetings and uh I think it's you I'm kind of romantic about it I think it's very special it's a good time for us to sort of listen to the public and uh and hear your concern so I appreciate you all being here um and I just wanted to share that I I I think it's it's very neat that we have that opportunity in our country um especially with regard to the First Amendment um you know I want to introduce everyone to our uh new communications director for district one Christie if you'd stand we don't have to stand but you can put her I told her I'd put her on the spot but uh we're delighted to have her on the team and she's going to be doing the community outreach for our office as well as myself and everyone else on our team because we think that's important so welcome to the team Christy we're we're glad to have you um you know tonight I am fortunate enough to be able to attend the Gilbert state of the city we're an amazing Town excuse me state of the town they are the biggest town in America but I'll be attending that with mayor Anderson and the rest of the council members and more importantly the public so uh if you're going to be there tonight look for me I'd love to meet you or uh reintroduce myself so thank you very much chairman thank you supervisor Stewart Madam Vice chair uh thank you very much I wanted to extend my thanks on behalf of me and my team to Sheriff Jerry Sheridan who gave us an extensive tour of the ITR and the towers the best and the worst of our jail system um it I received a lot of information I thank him for his time because he doesn't have much of it and look forward to additional understanding of our jail complex as we move forward to pass our jail tax which is a pillar Foundation of our Public Safety here in Maricopa County and I'd also like to give a shout out to uh Dave Martin and the association of general contractors I had a great meeting with them this morning gained a lot of input from from them from their members uh about things that Maricopa County can do to help keep building Maricopa County and from that the State of Arizona so thank you very much thank you madam Vice chair supervisor let's go thank you Mr chair first I want to uh address the audience and whoever is watching I welcome speakers to our meetings um I I do take seriously what you say but we also what I'm trying to put across if I didn't do it in a good way is we need decorum um in when I've been in the state legislature in Congress we always expect decorum so you just can't you know yell out things and so moving on from that I want to say that um both chairman Galvin and I um met with the EPA administrator Lee zeldon um recently and this is a serious issue because Maricopa County um could be reclassified in the serious zone of non um attainment for ozone and if that happens a lot of uh the big U manufacturing companies like tsmc or their suppliers just won't be able to fulfill the regulatory burden that uh President Biden's EPA Administration put on them and so I'm very pleased to announce that the EPA administrator Lee who I served with in Congress is very receptive uh to what um chairman galin and I asked um and and what others asked of him now I also want to say that I've been busy uh since we last met out in the community and I want to thank the following groups for everything that they do that I visited um I visited the Glendale rotary the Sun City Republican Club the Southwest chamber of Commerce uh I went to the US uh ASU decision theater with chairman Galvin because they were trying to say how they could be helpful in things like ozone uh went to the Luke uh Luke Air Force Base West Valley Council with a lot of the Mayors uh from the West Valley and I want to thank Brigadier General David Berkland who's the commander of the 56 Fighter Wing and thank all the men and women at Luke Air force spacee and uh the mayor of Elmer elmerage who's the co-chair of this Council um also went to the Sun City HOA and Sun City West HOA which is called pora legislative update and uh took questions from the audience uh constituents and also attended most recently the Sun City posi annual open open house and the sheriff's department had a lot of really cool vehicles and helicopters there so that was very fun as well so thank you um to all of you and I yield back supervisor Alco that's quite a list you've been really busy um and thank you for your comments and the Quorum it's really important for all of us to hear at the board what we do hear is the people's business statutorily we're required to have these meetings periodically every month but supervisor alesco made great comments and for me personally I really don't care what you say about me if you try to insult me I get it don't insult my colleagues I cherish them and respect them immensely and I really respect supervisor leco uh there's no way that I'm going to let anyone attack her character and integrity she has served this state in so many different ways over so many different years and literally no one cares more about the West Valley than Debbie leco and as you can see this list is just a small slice of what she's doing for this count County already she has hit the ground running and we rely as a board on her expertise and her Federal contacts uh she's too humble but when she talks about our meeting with the EPA and administrator Le Elden she has worked with Lee Eldon she knows Lee zeldon and she has worked with President Trump and she knows president Trump so we are immensely grateful to have supervisor Lesco here in the board and I will defend her to the end uh as for me in District 2 I am so happy to have attended the farm City breakfast it's one of my most uh favorite events and yesterday we had a great crowd great turnout probably the best I've seen uh I'm not going to take any credit for that turnout it was because mayor Mark Freeman was there and he is just doing a great job as mayor and it's his farm the Freeman corn patch and I really treasure our friendship and it was just great to see uh many friends and colleagues out there and I always want to highlight the county colleagues Who come out because they don't have to do it but they do it and I want to thank assessor Eddie cook and his staffer Don Marie buckin for being there and I want to uh thank Sheriff Jerry Sheridan who came out and to see the sheriff there was absolutely phenomenal I also want to thank the state legislators who came out including State Senate President Warren Peterson who I consider to be a good friend and also want to particularly thank state senator Tim Dunn who represents the West Valley and came all the way out to Mesa early in the morning didn't have to do it but he does it every year and as always I make sure to thank Senator Dunn for being there I'm also proud of the everyday adoption center that we opened up this weekend I spoke about that earlier so I'm not going to revisit that as supervisor alesco mentioned we went to visit with ASU in the decision theater to talk about different issues that we can see about using data and using resources and working together in a collaborative Fashion on economic development water transportation housing and Public Safety all of them so vital but it was also important I think for supervisor leco and I to let ASU know what's important for us and what are the issues we're particularly concerned about and one of them I want to highlight is the heat issues that we're going to have especially during the summer as unfortunately we brace ourselves for untimely debts also want to talk about the ozone non-entertainment Round Table supervisor leco also highlighted that I'm particularly proud of our staff of the county manager and our air quality director who are doing doing everything they can to push back on these onerous and counterproductive regulations coming from DC which are just trimming the sales of our economic progress and development and I'm proud that this board is standing United in a bipartisan way to push back on that but I'm confident under President Trump's leadership and with Lee zeldon the EPA we're going to turn the corner and we're going to make sure that those unnecessary regulations are knocked out and I look forward to future events here in my district before it gets too hot
